Aluminum Pans Dodge China Duties Through Thai-Viet Sneak Route?

Published Date: 7/11/2025

Notice

Summary

The U.S. is checking if aluminum containers made in Thailand and Vietnam using Chinese aluminum foil are sneaking around import taxes meant for China. This affects companies making or selling disposable aluminum pans and trays and could lead to new rules or fees soon. The investigation started after a group of U.S. manufacturers asked for it to protect their business.

Commerce Opens Circumvention Inquiries

The U.S. Department of Commerce has started country-wide circumvention inquiries to determine whether disposable aluminum containers completed in Thailand and Vietnam using aluminum foil made in China are evading the existing antidumping (AD) and countervailing duty (CVD) orders on aluminum containers from China. The probes specifically cover disposable aluminum containers, pans, trays, and lids completed in Thailand and the Socialist Republic of Vietnam using Chinese-made aluminum foil.

Investigation Prompted by U.S. Manufacturers

The inquiries were initiated after a request from the Aluminum Foil Containers Manufacturers Association (AFCMA) and specific U.S. member companies — Durable Packaging International; D&W Fine Pack, LLC; Handifoil Corp.; Penny Plate, LLC; Reynolds Consumer Products, LLC; Shah Foil Products, Inc.; Smart USA, Inc.; and Trinidad/Benham Corp. — seeking protection for their businesses. The request triggered Commerce to examine whether imports completed in Thailand and Vietnam using Chinese foil are circumventing the AD and CVD orders on Chinese imports.
