Published Date: 7/24/2025

Proposed Rule

Summary

The EPA is set to approve updated air pollution rules for the Mojave Desert area in California, helping local businesses get clearer permits for new or changed pollution sources. These changes fix past problems and keep the air cleaner without extra penalties for now. This update means smoother permit processes and a cleaner environment, with no new costs or sanctions hitting right away.

Updated NSR Permits for Mojave Businesses

The EPA is proposing conditional approval of five revised New Source Review (NSR) permitting rules for the Mojave Desert Air Quality Management District (MDAQMD) in California. If finalized, these revised rules will be added to the California State Implementation Plan (SIP) and will apply to new and modified sources of air pollution in the MDAQMD.

Sanctions Stayed or Deferred for Now

The EPA is issuing an interim final determination that will stay or defer the imposition of Clean Air Act (CAA) sanctions tied to its prior limited disapproval of MDAQMD rules. That means the CAA sanctions previously associated with the limited disapproval will not be imposed immediately while the interim determination is in effect.
