90‑Day Pre‑Notice for New Uses

If you manufacture or import the listed chemical substances, you must notify the EPA at least 90 days before starting any activity that the rule calls a "significant new use." "Manufacture" in this rule includes import. You may not begin the new manufacture or processing until EPA reviews the notice, makes a determination, and takes any actions required by that determination.

Which Substances Are Covered

The rules apply to certain chemical substances that were the subject of premanufacture notices (PMNs) and a Microbial Commercial Activity Notice (MCAN) and that are also subject to an EPA Order under the Toxic Substances Control Act (TSCA). Only persons who manufacture, import, or process those specifically listed substances are covered by the 90‑day notification requirement.
