New Pilot Lets Truck Drivers Split Their Sleeper Berth Breaks

Published Date: 9/17/2025

Proposed Rule

Summary

FMCSA is testing a new pilot program that lets about 256 truck drivers split their sleeper berth rest time instead of taking one long break. Drivers and their companies must qualify, and the program will run for 4 months to see if this new rest style keeps everyone safe. This could mean more flexible rest breaks without risking safety, with no extra costs for participants.

Pilot lets drivers split sleeper berth time

FMCSA proposes a pilot that would temporarily allow certain commercial drivers to split their required sleeper-berth rest time instead of taking one continuous 7-hour rest. The change would apply only to participants selected for the pilot and is intended to test whether split rest provides safety equivalent to the current single-period rule.

Pilot limited to ~256 drivers with data collection

Participation is limited to approximately 256 commercial drivers who hold a valid CDL and regularly use a sleeper berth, and both drivers and their motor carriers must meet eligibility criteria. Selected participants will provide FMCSA data during a 4-month study (1 month baseline under current rules, then 3 months operating under the exemption) so safety and fatigue can be compared.
