Nationwide Mass Influx Finding Extended

The Secretary of Homeland Security has found an actual or imminent mass influx of aliens at the southern border and is requesting assistance from State and local governments in all 50 States. The finding is effective immediately and will expire in 180 days.

State and Local Officers May Do Immigration Duties

Under the Finding and authorities in the Immigration and Nationality Act and 28 CFR 65.83, the Secretary may authorize a State or local law enforcement officer, with the consent of the officer's superiors, to perform duties of immigration officers under the INA.

ICE Capacity Strain and Enforcement Priorities

The notice states ICE had a detention population of 59,134 with a maximum capacity of 62,000 (about 95% occupancy) and that ICE prioritizes detention space for aliens with criminal records, public safety risks, and national security risks. The notice also reports 1,505,425 aliens on the ICE non-detained docket with final orders of removal and that ICE ERO has 6,204 officers and 9,960 vacancies (a 61% vacancy rate).
