120-Day Federal Enforcement Pause
The Attorney General must not enforce the Protecting Americans from Foreign Adversary Controlled Applications Act for 120 days from September 25, 2025. The Department of Justice will take no action or penalties for conduct that occurs during that 120-day period or that occurred before this order was issued.
Qualified Divestiture Conditions Announced
The President determined that a proposed divestiture would be a "qualified divestiture" if implemented. Under the Framework Agreement the U.S. app will be operated by a new U.S.-based joint venture that is majority owned and controlled by U.S. persons, with ByteDance and its affiliates owning less than 20 percent, and will require U.S. storage of sensitive user data and monitoring and retraining of recommendation models by trusted U.S. security partners.
No Liability Letters to Providers
The Attorney General must issue written guidance and letters to relevant providers stating there has been no violation of the Act and no liability for conduct during the 120-day period from September 25, 2025, and for conduct from the Act’s effective date through issuance of this order. Providers who distribute or host the listed applications are told they will not face penalties for that covered period.
