Big Deposit for Large Power Orders

If you order more than 32 kW of power during an Ordering Window at the Mahwah Data Center, your required deposit increases from two months' to six months' worth of the monthly recurring cost for the power ordered. The deposit is applied to your first and subsequent invoices once power is delivered and is returned if you withdraw the order during the Ordering Window. By example in the filing, four firms paid $17 million in deposits under the old rule; similar orders would require $51 million under the new rule.

Rule Change Effective Immediately

The Exchange filed the change on September 25, 2025 and designated it as a change to a fee, making the rule effective upon filing on September 25, 2025. The Commission may summarily suspend the change within 60 days of that filing if it determines temporary suspension is necessary.

Small Power Orders Stay the Same

If you order 32 kW or less during an Ordering Window at the Mahwah Data Center, your deposit requirement does not change — it remains equal to two months' worth of the monthly recurring cost for the power ordered. Orders of 32 kW or less continue to be allocated in "Step 2" before larger orders are considered.
