Waiver of Procurement and Other Laws

Effective October 15, 2025, the Secretary waived many federal legal requirements for all contracting actions needed to build the barriers and roads in the Del Rio Sector. The waiver expressly covers statutes and regulations including the Administrative Procedure Act (5 U.S.C. 551 et seq.) and a range of U.S.C. and CFR procurement provisions listed in the determination, applying to contracting, site access, earthwork, installation, and upkeep activities.

Immediate Border Construction in Del Rio Sector

Starting October 15, 2025, the Department of Homeland Security will immediately construct additional physical barriers and roads in the Del Rio Sector in Texas to deter unlawful entry. DHS says there were over 1,408,615 Border Patrol apprehensions between fiscal year 2021 and July 2025 in that sector, and it found large seizures of illegal drugs during that period.
