NFA transfer tax clarified

ATF revised Form 5320.4 to remove the $5 box and replace it with a $0 box, and the form instructions now state the transfer tax is $200.00 for machineguns and destructive devices and $0.00 for other types of firearms.

Form modernization and e-submission

ATF is updating Form 5320.4 to allow additional electronic/digital signatures, add references to eForms and pay.gov, link copy 1 and copy 2 in the fillable PDF, and permit electronic submission options. ATF says it is making forms electronically fillable across NFA forms and expects to move to solely electronic forms in 2026.

Paperwork time per applicant cut

DOJ estimates 546,424 respondents annually for Form 5320.4 with an estimated time per respondent of 12 minutes (0.2 hours), for a total annual time burden of 109,285 hours — down from the prior total of 446,755 hours (a reduction of 337,470 hours). The collection lists a total estimated annual other costs burden of $2,513,555.

CLEO copy and notification removed

ATF removed the requirement to provide a copy of Form 5320.4 to local chief law enforcement officers (CLEOs) and removed the CLEO notification/copy requirement from the form.
