Paperwork Continues; Annual Burden and Cost

If you operate an oil or natural gas facility subject to NSPS, you must continue to provide required reports and records. The renewal covers 417 respondents, with an estimated 54,300 hours per year and a total estimated cost of $11,000,000 per year (including $3,590,000 annualized capital or O&M costs). Responses are mandatory under 40 CFR part 60, subpart OOOO and occur semiannually or annually.

Which Subpart Applies by Construction Date

Which NSPS subpart applies depends on when a facility commenced construction, modification, or reconstruction: facilities begun after August 23, 2011 and on or before September 19, 2015 are subject to 40 CFR part 60, Subpart OOOO; after September 18, 2015 and on or before December 6, 2022 are subject to Subpart OOOOa; and facilities begun after December 6, 2022 are subject to Subpart OOOOb.

Types of Required Reports and Records

Affected owners/operators must submit initial notifications, performance tests, periodic reports, and must keep records of the occurrence and duration of any startup, shutdown, or malfunction and any period when monitoring systems are inoperative. These items are required to determine compliance with 40 CFR part 60, subpart OOOO.

Estimate Changes and Cost Drivers

The ICR shows a net decrease in burden due to a decrease in the number of existing sources and a growth rate of zero new sources, and a decrease in labor costs that was slightly offset by updated labor rates. There is an increase in capital and O&M costs driven by updated labor rates and updating dollar-year from 2012$ to 2023$ using the Chemical Engineering Plant Cost Index (CEPCI).
