Summary

The Social Security Administration is updating how it handles records related to Freedom of Information and Privacy Act requests. The updates take effect now, with some new sharing rules starting December 18, 2025, and the public can comment until then.

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Help for hearing or language barriers

If you need help communicating because of a hearing impairment or a language barrier, SSA may disclose records to third parties who assist communication (for example, interpreters or telecommunications relay system operators). This new routine use becomes effective December 18, 2025.

Records stored electronically (cloud)

SSA will maintain records in this system in electronic form and recognizes that information is also located in cloud-based services for business continuity purposes. That storage policy is stated in the notice published November 18, 2025.

ID or notarized proof required for access

If you request notification of or access to records by mail, you must include either a notarized statement verifying your identity or a written certification that you are who you claim to be. If you request access in person, you must provide an identity document (preferably with a photo) or sign the same written certification.
