OCC Eyes Ditching Old Fair Housing Data Collection for Banks

Summary
The Office of the Comptroller of the Currency (OCC) wants to get rid of an old rule that makes national banks collect certain home loan data. This rule is outdated, overlaps with other rules, and puts extra work on banks without helping much. Small Non-HMDA Banks Get Main Relief
The OCC says the main beneficiaries would be national banks that are non-HMDA reporters but originate more than 50 home loan applications annually, which are typically smaller national banks. Those institutions would no longer be required to collect and maintain the unique data required only by part 27.
National Banks Lose Part 27 Paperwork
The OCC proposes to rescind 12 CFR part 27, which would eliminate the Fair Housing Home Loan Data System paperwork requirement for national banks. The proposal would lead to discontinuing the related OMB information collection (OMB control number 1557-0159) and affects 702 respondents with a current total annual burden of 12,632 hours.
HMDA Reporters Still Collect HMDA Data
Banks that are HMDA reporters will continue to collect and maintain home loan data under Regulations B and C (the ECOA and HMDA implementing rules); rescinding part 27 does not change those obligations. HMDA-reporters will continue to file and retain the data required under Regulation C.
No Loss of Public Home Loan Data
The OCC states that part 27 data are not publicly available and that rescinding part 27 would not reduce the data external stakeholders use, because HMDA data (which is public) will still be collected and the OCC can obtain necessary information via other supervisory authorities. The OCC says rescission would not have a material impact on availability of data for fair housing supervisory activities.
