DOE NEPA rules remove draft/hearing requirements

Following CEQ and DOE actions in 2025, DOE rescinded many process-oriented NEPA requirements. The CEQ removal was effective April 22, 2025; DOE issued new NEPA Implementing Procedures on June 30, 2025 and an Interim Final Rule on July 3, 2025, and under those procedures DOE agencies are not required to publish draft environmental documents for public comment, hold draft public hearings, or wait 30 days after a final EIS before publishing a Record of Decision.

No draft SWEIS or public comment for Sandia

For Sandia National Laboratories in Albuquerque, NNSA will not publish a draft Site-Wide Environmental Impact Statement (SWEIS) for public comment and will not wait 30 days between the final SWEIS and its Record of Decision (ROD). NNSA expects to publish the final SWEIS and the ROD at the same time in late 2025.

No draft SEIS, hearings for LLNL; final + ROD together

For Lawrence Livermore National Laboratory in Livermore, NNSA will not publish a draft Supplemental Environmental Impact Statement (SEIS) for public comment, will not hold a public hearing on a draft, and will not wait 30 days between the final SEIS and issuance of the Record of Decision (ROD). NNSA expects to publish the final LLNL SEIS and the ROD at the same time in early 2026.
