HUD Redefines What Counts as Federal Benefits for Immigrants
Published Date: 11/26/2025
Notice
Summary
This notice explains how HUD defines “Federal public benefit” under a 1996 law that limits certain government help to non-citizens who aren’t qualified aliens. It updates previous HUD rules, clarifying who can get things like housing, food aid, or loans, and when providers must check eligibility. If you’re affected, expect clearer rules on benefits starting now, helping protect government funds and ensure fairness.

4 provisions identified: 0 benefits, 3 costs, 1 mixed.
Non‑Qualified Aliens Ineligible for HUD Benefits
HUD says that under the 1996 law (PRWORA), people who are not “qualified aliens” are not eligible for any HUD-provided “Federal public benefit” unless a specific exception applies. This means non‑qualified aliens can be denied HUD housing and related benefits that HUD treats as federal public benefits.
HUD Grants (Including Subgrants) Covered
HUD interprets the PRWORA phrase “any grant” to include grants it administers, including grants to States, local governments, nonprofits, and any subgrants. HUD says those grants are federal public benefits and are subject to PRWORA eligibility rules unless another statute specifically says otherwise.
Many HUD Housing Programs Are Covered
HUD says PRWORA applies to HUD programs related to “public or assisted housing” unless a more specific federal statute applies. HUD lists covered programs including HOME, HOME‑ARP, National Housing Trust Fund, CDBG, CDBG‑DR, HOPWA (formula and competitive), ESG, CoC, PRO Housing, PRICE, and SHOP as subject to PRWORA eligibility rules.
Verification Guidance and Who Must Verify
HUD will issue revised guidance on how to verify immigration status for programs not exempt under PRWORA and will rely on Department of Homeland Security guidance and the SAVE system. HUD says nonprofit charities administering benefits are not required to verify under 8 U.S.C. 1642(d), but States and other government actors must ensure programs comply.
