Higher Bar to Get Tier 7 Adding Credit

The NYSE will add a third requirement to qualify for the Tier 7 Adding Credit: a member organization must have 0.15% of Tape B and Tape C combined Adding ADV (excluding DMM). This is in addition to the existing requirements of 0.175% of Tape A Adding ADV and 0.02% of Tape B and Tape C combined for Non-Display Reserve orders; the existing credit amounts ($0.0029 displayed, $0.0018 non-displayed, plus $0.0007/$0.0006 NBBO/BBO increments) remain unchanged.

Elimination of Two Underutilized Remove Fees

The NYSE proposes to delete two underutilized fees for transactions that remove liquidity: (1) a fee structure adopted in September 2023 that charged $0.00300 in Tape A and $0.00295 in Tape B/C for non-Floor broker removals where a member had 0.05% Adding ADV of Tape A CADV, and (2) a fee structure charging $0.00295 in Tape A and $0.00290 in Tape B/C for non-Floor broker removals where a member had 0.10% Adding ADV of Tape A CADV and 0.007% Adding ADV in Tape B and Tape C CADV combined. The Exchange proposes to remove both fees in their entirety.

Adjusted Remove Fees for Several Tiers

The NYSE will modify fees charged for non-Floor broker transactions that remove liquidity: for members meeting 0.30% Tape A Adding ADV and 0.01% Tape B/C combined, the fee would change from $0.00290 (Tape A) / $0.00285 (Tape B/C) to $0.00300 (Tape A) / $0.00295 (Tape B/C). For members meeting 1.05% Tape A Adding ADV and 0.01% Tape B/C combined (or 0.05% Tape A plus operating a DMM in at least 25 securities), the fee would change from $0.00285 (Tape A and Tape B/C) to $0.00290 for Tape A, Tape B and Tape C.

Higher Remove Fees Specifically in Tape C

For Tape C securities at or above $1.00, the NYSE will revise remove fees: the fee for members achieving a 0.25% Adding Tape C percentage of Tape C CADV changes from $0.0026 to $0.0027 per share, and the fee for members achieving a 0.10% Adding Tape C percentage of Tape C CADV changes from $0.0027 to $0.0028 per share. The qualification requirements for those tiers remain unchanged.
