Dealers: Continued Buyers Guide Requirement
The FTC proposes to extend for three more years the Used Car Rule that requires used car dealers to display a one-page, double-sided Buyers Guide on each used car offered for sale. The agency estimates the Rule’s disclosure requirements create an annual burden of 3,164,100 hours, $69,167,226 in labor costs, and $19,300,000 in non-labor costs.
Spanish-Language Sales Add Extra Burden
When a dealer conducts a sale in Spanish, the Rule requires making contract disclosures in Spanish and permits posting both English and Spanish Buyers Guides. FTC staff estimates dealers will conduct about 8.4% of sales in Spanish (approximately 3,242,400 sales), adding estimated burden hours for completing Spanish Buyers Guides (54,040 hours for as-is sales; 81,060 hours for warranty sales) and 94,570 hours for displaying the additional Spanish Buyers Guides.
Buyers Guides Help Consumers Make Choices
The Rule requires dealers to display a Buyers Guide on each used car that discloses warranty coverage and other information to help purchasers make informed decisions. The FTC states the Buyers Guide requirement "promotes informed purchasing decisions."
