This update fixes small mistakes and clears up confusing parts in HUD’s Housing Choice Voucher and Project-Based Voucher rules from 2024. No Eviction for Abated Vouchers
If your housing assistance is withheld or abated, the owner may not terminate your tenancy because of that withholding. During the abatement you may end the lease by notifying the owner and the PHA, and the PHA must promptly issue you a voucher; the HAP contract ends on the tenancy termination date or the date you move out.
You Can Decline Unsafe PBV Units
If you are referred from a project-based voucher (PBV) waiting list, you may decline an offered unit because of unit conditions and remain on the waiting list. If you report a deficiency before the PHA inspects, the PHA must inspect within the required time or within 30 days of the proposal or project selection date, and if non-life-threatening repairs are not fixed within the cure period (which may not exceed 180 days), the PHA can remove the unit from the HAP contract and issue you a voucher.
PHAs Can Use Small Area FMRs After Notice
A public housing agency (PHA) may choose to apply Small Area Fair Market Rents (Small Area FMRs) to its HCV program after it notifies HUD, and HUD is no longer required to approve such voluntary PHA requests. This change clarifies Sec. 888.113 and takes effect January 7, 2026.
