A trade group (NAAA) commented that up to 758 agricultural aircraft operations could use the waiver and estimated a savings of $1,378.08 per day for a single agricultural aircraft from adopting the waiver.
States may waive HM endorsement
Starting March 10, 2026, States may waive the hazardous materials (HM) endorsement for holders of a Class A commercial driver's license who transport up to 1,000 gallons of aviation-grade jet fuel in support of seasonal agricultural aircraft operations within their State of domicile or in another State that has adopted the same waiver.
Per-driver HM endorsement savings
Drivers who qualify for the waiver will avoid about $260 in costs to obtain an HM endorsement: roughly $99 for theory training, $61.50 in opportunity cost for training time, an $85.25 TSA background fee, and an average $14 State driver's licensing agency fee.
TSA background check exemption
A State-granted waiver for eligible drivers will also exempt those drivers from the Transportation Security Administration (TSA) background records check (Security Threat Assessment) in 49 CFR part 1572, subpart B.
No waiver when crossing non‑participating states
Drivers transporting jet fuel across State lines into a State that has not adopted the waiver must still obtain an HM endorsement; the waiver applies only within a driver's State of domicile or in other States that adopt the waiver.
Waiver limited to Class A CDL holders
The final rule applies only to holders of a Class A commercial driver's license; FMCSA declined to extend the HM endorsement waiver to Class B CDL holders or to non-CDL (State-designated Class D) drivers.
