Limits on access to harassment records
If you are a current NCUA employee or contractor, then effective January 12, 2026 the NCUA system NCUA-28 (Anti-Harassment Case Tracking and Records) is exempt from Privacy Act subsections (c)(3), (d), (e)(1), (e)(4)(G), (e)(4)(H), (e)(4)(I), and (f). That means NCUA need not provide an accounting of disclosures, grant access to records, or follow the routine notice, correction, and publication rules for these investigatory records; however, if information in the system is used to deny you a right, privilege, or benefit you will be provided the information unless disclosure would identify a confidential source. Comments on this interim final rule are due by February 11, 2026.
