Landowners: Eminent Domain Risk
If you are a landowner in the project area, a pipeline company may contact you to buy an easement but you are not required to agree. If the Commission approves the project, the Natural Gas Act conveys the right of eminent domain to the company and it could initiate condemnation proceedings in court; compensation would be determined by a judge under state law.
Construction Will Disturb Hundreds of Acres
The project would build about 42 miles of new 30-inch pipeline in Rowan, Fleming, and Mason Counties, Kentucky, and construction would disturb about 770 acres of land. After construction, Columbia would maintain about 260 acres for permanent operation and about 31% of the route is within or adjacent to existing corridors.
Public Comment Deadline and Meetings
You can submit written or oral comments on the project's environmental scope, and the Commission must receive comments by 5:00 p.m. Eastern Time on February 6, 2026. The Commission is holding public scoping sessions on January 28, 2026 (Maysville) and January 29, 2026 (Flemingsburg) from 5:00 to 7:00 p.m. Eastern Time.
NEPA Review Could Trigger More Comments
FERC staff will decide whether to prepare an Environmental Assessment (EA) or an Environmental Impact Statement (EIS); if staff prepares an EIS, a Notice of Intent and an additional public comment period will be opened. The environmental document will evaluate impacts like water, wetlands, wildlife, cultural resources, air quality, and noise.
