Korean Wind Towers Hit with US Dumping Duty Probes

The U.S. Department of Commerce found that Korean companies sold big wind towers for less than fair value from August 2023 to July 2024. They’re stopping the review for some companies that didn’t ship any towers during that time. Preliminary Duty Finding: Dongkuk 4.99%

Commerce preliminarily found that Dongkuk S&C Co., Ltd. dumped utility-scale wind towers for the period August 1, 2023 through July 31, 2024 and calculated a weighted-average dumping margin of 4.99 percent. If finalized, importers of Dongkuk wind towers may be assessed antidumping duties calculated from that review and importer-specific ad valorem assessment rates will be applied; unreviewed entries where Dongkuk did not know the merchandise was destined for the U.S. may be liquidated at the all-others rate.

Cash Deposit Rules for Future Shipments

For shipments entered or withdrawn for consumption on or after the publication date of the final results of this review, cash deposit requirements will apply: the cash deposit rate for Dongkuk will be the rate established in the final results (unless the rate is less than 0.50 percent, in which case the deposit is zero); company-specific rates remain for previously reviewed firms; manufacturer rates apply where the exporter is not covered; and the all-others rate remains 5.41 percent.

Rescission for Eight Companies — Cash Deposit Rates Apply

Commerce is rescinding the review in part for eight named companies (CS Wind Corporation; Enercon Korea Inc.; Hyosung Heavy Industries; Nordex SE; Siemens Gamesa Renewable Energy Limited; Unison Co., Ltd.; Vestas Korea Wind Technology Ltd.; Win&P., Ltd.) because they had no entries during August 1, 2023–July 31, 2024. For entries produced or exported by those companies, Commerce will instruct U.S. Customs and Border Protection to assess antidumping duties at the cash deposit rate that was required at the time of entry or withdrawal from warehouse; rescission instructions will be issued no earlier than 35 days after publication of this notice.
