Overall Paperwork Burden for Hemp Program

USDA estimates the Domestic Hemp Production Program involves 21,781 respondents, 23,719 total responses, an average of 32 responses per respondent, 0.41 hours per response, and a total annual burden of 8,018 hours.

USDA Hemp License Application Required

If you want to grow hemp under the USDA plan, you must submit the AMS-26 USDA Hemp License Application with your name, address, contact info, business EIN (if applicable), and key participants. Each producer entity must submit its own application to participate under the USDA plan.

Annual Producer Report Due December 15

Every licensed producer under the USDA program must file the AMS-28 USDA Hemp Plan Annual Report by December 15 each year reporting acreages planted, harvested, remediated, and disposed of under their license.

Report Acreage to FSA (FSA-578)

Each producer under a State, Tribal, or USDA plan must complete the Report of Acreage (FSA-578) to report name, address, license number, geospatial location for each lot or greenhouse, and hemp crop acreage to the USDA Farm Service Agency.

Disposal Reporting Deadline for Producers

If cannabis tests above the 0.3 percent THC threshold under the USDA plan, the producer must submit the AMS-27 USDA Hemp Plan Disposal Form no later than 30 days after the disposal/remediation date with producer name, license number, location, disposal method, disposal agent, and disposal date.

Laboratories Must Report THC Test Results

Laboratory personnel must record each THC test result on the AMS-22 Laboratory Test Results Report, including producer contact info, license number, lot identification, test result, and whether the result is passing, failing, or retesting.

Monthly State/Tribal Reporting to USDA

States and Tribes with approved hemp plans must submit AMS-23 State and Tribal Hemp Producer Reports and AMS-24 State and Tribal Hemp Disposal Reports to USDA on the first business day of each month with contact, license, land description, and disposal information.
