Form 5320.20 Goes Electronic

If you apply to move certain National Firearms Act (NFA) firearms across state lines or temporarily export them, ATF is making Form 5320.20 electronically fillable so you can sign it electronically and submit it by email or through ATF's eForms platform. ATF says this will allow full electronic submission and an auto-filled second copy.

You Must File Form 5320.20 Before Transport

If you want to transport certain NFA firearms (machine guns, short‑barreled rifles, short‑barreled shotguns, or destructive devices) out of the state where they are registered or temporarily export them, you must submit ATF Form 5320.20 to ATF before you may transport the items, under 18 U.S.C. 922(a)(4) and 27 CFR 478.28. The filing is generally done once annually.

Estimated Filing Burden and Costs Quantified

ATF estimates 12,878 respondents will submit this form, at an average of 0.167 hours per respondent, for a total annual burden of 2,151 hours and total annual other costs of $0. The agency states the collection frequency is once annually.

ATF Reviewing Possible Rule Relief Options

ATF says it is reviewing the approval process for NFA transport requests to look for ways to relieve administrative burdens and is considering options suggested by commenters, such as limiting Form 5320.20 to permanent interstate transports or temporary exports or converting some filings to notification‑only processes. ATF has not adopted such changes but is considering them.
