Published Date: 2/9/2026
Notice
Summary
The U.S. government says Australian silicon metal is being sold in the U.S. for less than it should be, which could mean extra duties soon. This affects Australian exporters and U.S. buyers, with the final decision delayed to give everyone more time. Provisional measures are extended, so money rules might change after March 31, 2025.

Preliminary Finding: Dumping Found
The Department of Commerce preliminarily determined that silicon metal from Australia is being sold in the U.S. at less than fair value (LTFV). The period of investigation covers April 1, 2024 through March 31, 2025, and this preliminary determination was published on February 9, 2026.
6.28% Dumping Margin Assigned
Commerce preliminarily calculated an estimated weighted-average dumping margin of 6.28 percent for Simcoa Operations Pty Ltd. and assigned an all-others rate of 6.28 percent to other producers and exporters of silicon metal from Australia.
Importers Must Post Cash Deposits
Commerce will direct U.S. Customs and Border Protection to suspend liquidation and require a cash deposit equal to the estimated dumping margin (6.28%) for entries of the subject merchandise entered, or withdrawn from warehouse for consumption, on or after the date of publication of this notice (February 9, 2026). These suspension instructions will remain in effect until further notice.
Final Decision Delayed; Provisional Measures Extended
Commerce is postponing the final determination and extending provisional measures from a four-month period to a period not greater than six months; Commerce will make its final determination no later than 135 days after the date of publication of this preliminary determination. Requests to postpone and extend were submitted on September 29, 2025 and January 26, 2026.
No Countervailing Offset Applied
Commerce notes that the companion countervailing duty (CVD) investigation preliminarily found no export subsidies for silicon metal from Australia; therefore Commerce made no offset to the estimated weighted-average dumping margin.
