Country-wide Inquiry Could Expand Duties
Commerce has initiated a country-wide circumvention inquiry (applicable February 10, 2026) to decide whether mattress components exported from Malaysia and completed or assembled in the United States are circumventing the antidumping duty order on mattresses from Malaysia. If Commerce finds circumvention, those products could be included within the scope of the Order and become subject to antidumping duties.
Importers Face Continued Cash Deposits
Starting February 10, 2026, U.S. Customs and Border Protection (CBP) will be notified to continue the suspension of liquidation for entries subject to this inquiry and to apply the cash deposit rate that would apply if the product were covered by the antidumping order. If your company imported mattress products or components tied to this inquiry, CBP may require cash deposits on those entries while the inquiry proceeds.
Not Responding Can Trigger Adverse Rulings
Commerce will issue questionnaires to potential respondents and says a company's failure to completely respond may lead to the use of partial or total facts available under section 776(a) and adverse inferences under section 776(b). That can result in less favorable duty calculations for companies that do not fully cooperate with the inquiry.
Preliminary Decision Within 150 Days
Commerce intends to issue a preliminary circumvention determination within 150 days from the date of publication of the initiation notice in the Federal Register (publication date February 10, 2026). A preliminary determination could affect whether duties are applied while the inquiry continues.
