Countrywide Circumvention Inquiry Launched
On February 10, 2026, Commerce began a country-wide inquiry into whether mattress components exported from Poland and finished into mattresses in the United States are circumventing the existing antidumping duty order on mattresses from Poland. If Commerce finds circumvention, those products could be included within the scope of the antidumping duty order and subject to antidumping duties. Commerce intends to issue questionnaires to producers and may issue a preliminary determination within 150 days of this notice's publication.
Suspension of Liquidation and Cash Deposits Continue
Commerce will notify U.S. Customs and Border Protection (CBP) to continue the suspension of liquidation for entries already under suspension and to apply the cash deposit rate that would apply if the products were determined to be covered by the Order. That direction takes effect with the initiation notice (February 10, 2026) and applies to entries of products subject to this circumvention inquiry.
Respondents Must Answer Questionnaires or Risk Penalties
Commerce intends to send quantity-and-value and other questionnaires to producers and exporters and will select respondents based on those responses. A company's failure to fully respond may lead Commerce to apply facts available, including adverse inferences, which can affect the duties applied to that company.
