Notice
Summary
The FDA is asking for feedback on rules that keep cigarettes and smokeless tobacco away from kids and teens. Tobacco makers, sellers, and advertisers must tell the FDA if they plan to use new types of ads or labels not already approved. Comments are open until March 20, 2026, and this helps make sure tobacco stays out of young hands without adding extra costs.

Tobacco Firms Must Notify FDA
If you are a tobacco product manufacturer, distributor, or retailer and plan to use an advertising or labeling medium not listed in 21 CFR 1140.30(a)(1), you must notify FDA describing the medium and how much it may be seen by persons younger than 18. The notice must be submitted 30 days before using the medium.
Short, Flexible Submission Process
FDA allows electronic or mail submission of the notices and provides guidance on formatting; FDA estimates each notice takes about 1 hour and expects about 4 notices per year. FDA states there are no capital or operating costs associated with this collection.
