Michigan’s environmental agency (Michigan EGLE) has until February 3, 2027 to approve or deny the Clean Water Act section 401(a)(1) water quality certification request submitted for the STS Hydropower and Van Buren Township project. If Michigan EGLE does not act by February 3, 2027, the certification is automatically deemed waived under section 401(a)(1), allowing the project to proceed without that state certification.
