Korean Steel Plates Face Tweaked Taxes After Shutdown

Summary

The U.S. Department of Commerce found that some Korean steel makers got unfair government help in 2023, so they’re adjusting the extra taxes (countervailing duties) on certain steel plates from Korea. These changes kick in starting February 20, 2026, and could affect importers and buyers by changing costs. Deadlines were pushed back due to a government shutdown, but now the final results are set and ready to roll!

Final duty rates on Korean CTL steel

Commerce found that Dongkuk Steel Mill Co. received a 2.21 percent ad valorem countervailable subsidy rate and Hyundai Steel Company received a 1.31 percent rate for the period January 1, 2023 through December 31, 2023. U.S. Customs and Border Protection (CBP) will assess countervailing duties on appropriate entries of subject cut-to-length carbon-quality steel plate at those rates.

Cash-deposit collection begins February 20, 2026

Commerce intends to instruct CBP to collect cash deposits of estimated countervailing duties in the amounts shown for the companies subject to this review for shipments entered, or withdrawn from warehouse, for consumption on or after the date of publication of the final results (Applicable February 20, 2026). These cash deposits will remain in effect until further notice.

Assessment timing and liquidation hold rules

Commerce intends to issue assessment instructions to CBP no earlier than 35 days after the date of publication of these final results. If a timely summons is filed at the U.S. Court of International Trade, the assessment instructions will direct CBP not to liquidate relevant entries until the time for parties to file a request for a statutory injunction has expired (i.e., within 90 days of publication).

Cross-owned affiliates may be covered

Commerce preliminarily finds that Dongkuk Holdings Co., Ltd. is cross-owned with Dongkuk Steel Mill Co., and that Hyundai Green Power Co., Ltd., Hyundai IFC Co., Ltd., and Hyundai ITC Co., Ltd. are cross-owned with Hyundai Steel Company. These affiliates may be subject to the same countervailing duty treatment as the named producers/exporters.
