Commerce Slaps Duties on Indian Off-Road Tires Again

Importer Certification: Risk of Double Duties
Importers must file a certificate about reimbursement of antidumping duties before liquidation of the relevant entries for this review period. If an importer fails to file this certificate, Commerce may presume reimbursement occurred and assess double antidumping duties.
Updated Antidumping Duties Take Effect
If you import certain new pneumatic off-the-road tires from India, updated antidumping duties take effect for entries on or after February 26, 2026. The Department of Commerce found sales below normal value for the period March 1, 2023 through February 29, 2024, and that finding triggers new duties starting February 26, 2026.
3.78% Duty Applied to Some Producers
Commerce determined a weighted-average dumping margin of 3.78 percent for ATC Tires Private Ltd./ATC Tires AP Private Limited and assigned that same 3.78 percent rate to companies not selected for individual examination for the March 1, 2023–February 29, 2024 period. Importers of merchandise from those companies will face duties at that rate for applicable entries.
New Cash Deposit Rules at Entry
For shipments entered or withdrawn from warehouse for consumption on or after February 26, 2026, importers must post cash deposits equal to the weighted-average dumping margin established in this review, except that rates under 0.50 percent are treated as de minimis and set to zero. Other previously established company-specific or all-others rates continue to apply as described in the notice.
Zero Duty for Asian Tire Factory
Commerce calculated a weighted-average dumping margin of 0.00 percent for Asian Tire Factory Ltd. and Lyallpur Rubber Mills for March 1, 2023–February 29, 2024. Importers of merchandise from these companies will not be assessed antidumping duties for that period.
