In‑Water Remedy: $668M Obligation

Covenant Not To Sue For Settling Parties
In return for their payments and performance, settling defendants and settling federal agencies will receive a covenant not to sue under sections 106 and 107 of CERCLA and under RCW 70A.305.040 of Washington’s Model Toxics Control Act. The covenant covers the matters resolved by the proposed consent decree.
United States to Pay $140M Share
The United States, on behalf of several settling federal agencies, will pay $140 million as part of the proposed consent decree addressing hazardous substance releases at the Lower Duwamish Waterway Superfund Site.
