New Trade Agreement Dollar Thresholds
If you are a business working with the U.S. Government, new dollar thresholds determine when trade agreements apply. Key thresholds (USTR-specified) include the WTO GPA at $174,000 for supply and service contracts and $6,683,000 for construction; many FTAs set supply and service thresholds at $105,767 (some at $174,000 or $100,000), and the Israeli Trade Act supply threshold is $50,000. These USTR thresholds are effective January 1, 2026 and the FAR implements them effective March 13, 2026.
Covered Offers Get Equal Consideration
For acquisitions covered by the WTO GPA or FTAs, the USTR has waived Buy American and other discriminatory provisions so eligible products and services will receive equal consideration with domestic offers when the estimated contract value meets or exceeds the new thresholds. The FAR is amended to reflect those thresholds so contracting officers apply the waivers for covered procurements.
No New Burdens for Small/Commercial Acquisitions
The rule states it does not add new burdens or change applicability of FAR clauses for acquisitions at or below the Simplified Acquisition Threshold or for commercial products or services, other than updating the trade agreement thresholds themselves. The agencies say the threshold updates simply accommodate economic changes and are not expected to impose significant costs or administrative impacts on contractors or offerors.
