BE-13 Survey Remains Mandatory
If your business has a new foreign direct investment in the United States, you must continue to complete the BE-13 survey under OMB Control Number 0608-0035. The survey is mandatory and applies whether or not BEA contacts you; companies that are contacted but do not meet reporting requirements must still respond to say they do not meet them.
Annual Follow-Up Filing Requirement
If your U.S. business was established or expanded by foreign investors, you may need to file form BE-13E annually for up to three years after the year of establishment or expansion. The notice states about 165 respondents will file BE-13E and that the average response time across forms is 0.6 hours.
Large Use of Exemption Claim Form
Many businesses claiming they are exempt must file a BE-13 Claim for Exemption once for a new investment; the notice estimates 2,727 respondents will file the Claim for Exemption form. All one-time filers and other BE-13 forms together total about 3,417 respondents annually with a combined burden of 2,032 hours.
