State Dept Seeks Feedback on Defense Broker License Forms Extension

Published Date: 4/6/2026

Notice

Summary

The Department of State wants to keep collecting info from people who broker defense deals and is asking for your thoughts by June 5, 2026. This affects U.S. and foreign brokers who need a license before making certain defense-related trades, and it usually takes about 2 hours to fill out the form. No big changes or extra costs are planned, just a smooth extension of the current process.

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

Prior-approval license required for brokers

If you are a U.S. or foreign person who brokers defense articles or defense services controlled by the International Traffic in Arms Regulations (ITAR) part 129, you must register with the Directorate of Defense Trade Controls (DDTC) and submit a Brokering Prior Approval request using form DS-4294. You must receive DDTC's consent before engaging in such brokering activity unless you are exempted.

Estimated 2-hour paperwork burden

Filling out the Brokering Prior Approval form (DS-4294) is estimated to take about 2 hours per response. The Department estimates 170 respondents, 170 responses, and a total estimated burden of 340 hours for this collection.

Electronic submission through DECCS available

Applicants may submit the Brokering Prior Approval Request (DS-4294) electronically via DDTC's Defense Export Control and Compliance System (DECCS). The collection therefore provides an electronic filing option for respondents.
