Aircraft Impact Rule Gets Conditional Sunset
The NRC added a conditional sunset to the Aircraft Impact Assessment rule (10 CFR 50.150). The change is effective April 8, 2026, and 10 CFR 50.150 will cease to have effect on April 8, 2027 unless the NRC extends that date after offering the public an opportunity to comment; any extension may be to a date no more than 5 years in the future.
Sunset Allows Design Changes Under 10 CFR 50.59
If 10 CFR 50.150 is removed after the conditional sunset process, licensees could make certain changes to facility designs related to aircraft impacts under the general change-control provisions of 10 CFR 50.59. The rule notes the 50.59 process still requires evaluation of safety impacts before such changes are made.
Operating Plants Not Immediately Affected
Currently operating nuclear plants will not be affected by the sunsetting of 10 CFR 50.150 because the AIA analyses are incorporated into each plant's licensing basis. Any licensee-initiated change after sunsetting would be controlled through the 10 CFR 50.59 change process.
New Reactor Applicants Still Must Assess Aircraft Hazards
Applicants for new reactor permits, licenses, and certifications must still assess hazards from aircraft accidents as required by 10 CFR part 100 to determine whether those hazards belong in the design basis. Sunsetting 10 CFR 50.150 does not remove the part 100 requirement for aircraft-hazard assessment for applicants.
