Nationwide Reporting Scale, Hours, and Costs

EPA estimates 471,787 facilities (including 3,052 LEPCs and SERCs) are respondents to these EPCRA sections; the annual estimated burden is 6,963,271 hours and the total estimated annual cost is $306,735,727, which includes $1,715,094 in annualized capital or operation & maintenance costs. EPA says burden hours are likely to stay substantially the same under the proposed ICR extension.

Annual Tier II Chemical Inventory Filing

If your facility is subject to the OSHA Hazard Communication Standard, you must file the Tier II Emergency and Hazardous Chemical Inventory Form each year on or before March 1 reporting hazardous chemicals present in the previous calendar year (thresholds are specified in 40 CFR part 370). All states require submission of the Federal Tier II form or a state-equivalent, including electronic submission.

One-Time SDS or Chemical List Submission

Owners and operators subject to the OSHA Hazard Communication Standard must submit a list of chemicals or Safety Data Sheets (SDSs) to the State Emergency Response Commission (or Tribal equivalent), Local Emergency Planning Committee (or Tribal equivalent), and the local fire department for chemicals exceeding thresholds in 40 CFR part 370. This 311 submission is one-time unless the facility newly becomes subject to the rules or updates previously submitted hazardous chemical information.
