Investigation Could Block Patch Imports

If you import or sell over-the-counter topical lidocaine patches in the United States, the U.S. International Trade Commission began an investigation on April 9, 2026 into alleged infringement of U.S. Patent No. 12,109,181. The complainant asked the Commission to issue a limited exclusion order and cease and desist orders after the investigation, which could stop the importation or sales of the accused patches.

Respondents Face 20-Day Response Deadline

Companies named in the complaint must file responses according to the Commission's rules, and the Commission will consider responses received not later than 20 days after service of the complaint and notice of investigation. If a named respondent fails to file a timely response, the Commission may treat that failure as a waiver and could issue an exclusion order or cease and desist order without further notice.
