Analyzed Economic Effects
5 provisions identified: 2 benefits, 3 costs, 0 mixed.
Startup/Shutdown Exemptions Removed
The approved November 13, 2024 version of Rule 425.3 removes exemptions that previously applied to NOX emission limits during startup and shutdown and replaces them with alternative NOX limits. This change takes effect May 18, 2026 and applies to Portland cement kilns in Eastern Kern.
Breakdown Exemption Eliminated
The SIP revision removes the previous exemption from NOX limits during breakdown conditions for Portland cement kilns in Eastern Kern and replaces it with enforceable limits in the November 13, 2024 rule. The change is federally effective May 18, 2026.
Sanctions and FIP Clocks Permanently Ended
EPA's approval replaces the prior SIP version and resolves the deficiencies that led to the June 5, 2023 limited disapproval; this action permanently terminates all sanctions clocks and Federal Implementation Plan (FIP) clocks that were triggered by the 2023 action. The termination is effective May 18, 2026.
Rule Becomes Federally Enforceable
The EPA approved Eastern Kern Rule 425.3 (amended November 13, 2024) into the California SIP and made it federally enforceable under Clean Air Act sections 110 and 113 as of May 18, 2026. If you operate a Portland cement kiln in Eastern Kern, you must follow the updated NOX requirements once the rule is effective.
EPA Finds No Significant Small-Entity Impact
EPA certified that this SIP approval is not expected to have a significant economic impact on a substantial number of small entities under the Regulatory Flexibility Act. That certification accompanies the final approval effective May 18, 2026.
