Good Cause Appeals and 50% Settlement Rule
Under Section 16, a State assessed financial liability after two consecutive years of excessive error may appeal for good cause and may settle by investing 50 percent of the total QC liability in new activities; States must submit new investment plans (FNS-74A) and biannual progress reports (FNS-74B). The collection estimates 320 reporting hours for the good cause process, 352 hours for new investment plans, and 150 hours for progress reports.
SNAP QC Info Collection Reinstated
The USDA/FNS is seeking to reinstate OMB Control Number 0584-0303 for SNAP Quality Control (QC) reporting and recordkeeping and invites comments by June 29, 2026. The collection covers 53 State agencies and the agency estimates a revised annual reporting and recordkeeping burden of 2,532.36 hours in total.
State QC Sampling Plans Required
Each State agency must develop and submit a QC sampling plan to show integrity of case selection; the agency estimates 1,060 annual reporting hours for sampling plans and 1.25 annual recordkeeping hours. This requirement implements 7 CFR part 275 and remains part of each State's plan of operations.
QC Arbitration Process Preserved
If a State and FNS disagree on QC case findings, the State may request arbitration by submitting a written explanation; the collection estimates 646 annual reporting hours associated with arbitration (a decrease of 578 hours from the previous collection).
Third-Party Contractor Notice Rules
State agencies that hire third-party contractors for SNAP QC must notify FNS of intent to hire, submit signed contracts and deliverables, notify FNS at least 10 days before contractor-led trainings, and allow FNS to attend those trainings. The notice and submission tasks carry small per-action reporting time estimates (0.25, 0.5, 0.5, and 0.4 hours respectively).
