Missouri Now Enforces Local Ammonia Safety
Starting May 29, 2026, the Missouri Department of Natural Resources (MoDNR) has primary authority to implement and enforce parts of the Clean Air Act Risk Management Program (RMP) for agricultural anhydrous ammonia facilities in Missouri. The delegation covers on-site inspections, recordkeeping reviews, audits, compliance assistance, outreach, and enforcement for those agricultural anhydrous ammonia facilities as defined in 10 CSR 10-6.255.
No New Federal Costs for Missouri Small Businesses
The EPA certified that approving Missouri's partial delegation does not impose additional requirements beyond those already in Missouri law and is certified as not having a significant economic impact on a substantial number of small entities. This certification and the rule are effective May 29, 2026.
10,000‑Pound Facilities Must Follow RMP
Facilities in Missouri that use, store, or sell agricultural anhydrous ammonia and meet the threshold quantity of 10,000 pounds must comply with the RMP provisions of 40 CFR part 68; Missouri regulation 10 CSR 10-6.255 (effective February 28, 2025) is incorporated by reference and is federally enforceable as of May 29, 2026. The definition of agricultural anhydrous ammonia and the 10,000 pound threshold are set in 10 CSR 10-6.255.
