DoD Lists FPI >5% Market Categories

If you sell to the Department of Defense, the DoD published an updated list of product categories where Federal Prison Industries (FPI) holds more than 5% of the DoD market, effective May 16, 2026. The listed categories are 7110 (Office Furniture), 7210 (Household Furnishings), 8105 (Bags and Sacks), 8125 (Bottles and Jars), and 8420 (Underwear and Nightwear, Men's).

FPI Must Be Included In Solicitations

For the product categories on the May 16, 2026 list, DoD contracting officers must include Federal Prison Industries (FPI) in the solicitation process and consider any timely offer from FPI under FAR 8.602(a)(4)(ii)–(v). That means FPI offers must be evaluated when awarding contracts for those listed items.

Non-Listed Items Still Follow FAR 8.6 Rules

If an item is not on the May 16, 2026 list, DoD acquisitions continue under FAR subpart 8.6 and contracting officers may perform market research and written comparability determinations. Competitive or fair opportunity procedures apply when an FPI product is not comparable in price, quality, or delivery time.
