U.S. Probes Indian Sodium Nitrite Subsidies in Trade Review

Preliminary Countervailing Rates Announced

Commerce preliminarily assigned countervailable subsidy rates for sodium nitrite imports for the period January 1, 2024 through December 31, 2024: Deepak Nitrite Limited 2.26%, Kronox Lab Sciences Pvt Ltd 2.26%, and Kutch Chemical Industries Limited 63.60%. These preliminary rates are published as of the notice applicable May 13, 2026.

Rescission for Three Companies

Commerce intends to rescind the administrative review for Buradon Inc.; Palvi Industries Limited; and Lotus Global Pvt. Ltd. because CBP import data show no reviewable suspended entries during January 1, 2024–December 31, 2024. For those companies, Commerce will instruct U.S. Customs and Border Protection to assess duties at the cash deposit rate required at time of entry per 19 CFR 351.212(c)(1)(i).

Cash Deposit Rules and All‑Others Rate

Commerce intends that, upon final results, CBP will collect cash deposits for shipments entered or withdrawn for consumption on or after the date of publication of the final results equal to company-specific estimated subsidy rates from the final results. If a rate is less than 0.50 percent it will be treated as zero; if both producer and exporter have company-specific rates the higher rate applies; if only one has a rate, that rate applies. The cash deposit rate for all other producers and exporters will remain 2.40 percent.

Rate Assignment Methodology for Unexamined Company

For a company not selected for individual examination (Kronox Lab Sciences Pvt Ltd), Commerce preliminarily assigned a countervailable subsidy rate based on the rate calculated for Deepak Nitrite Limited. Commerce also preliminarily treated the rate calculated for Kutch Chemical Industries Limited as based entirely on facts available.

Timing for Assessment and Liquidation Holds

Commerce intends to issue rescission instructions to CBP no earlier than 35 days after publication of this notice, and to issue assessment instructions for specified companies no earlier than 35 days after publication of the final results. If a timely summons is filed at the U.S. Court of International Trade, assessment instructions will direct CBP not to liquidate relevant entries until the statutory injunction period has expired (within 90 days of publication).
