Full Waiver of Major Environmental and Historic Laws
For construction in the project area, DHS waived in their entirety a long list of federal statutes (effective May 15, 2026), including the National Environmental Policy Act, Endangered Species Act, Clean Water Act, National Historic Preservation Act, Migratory Bird Treaty Act, Native American Graves Protection and Repatriation Act, Clean Air Act, and many other environmental, cultural, and procedural laws, allowing earthwork, staging, installation, and related activities to proceed without compliance with those laws.
Immediate Border Construction in Big Bend
The Secretary of Homeland Security determined on May 15, 2026 that DHS will immediately construct additional barriers and roads in a defined segment of the Big Bend Sector on the Texas border (from approximately GPS 29.7275568,-101.6848011 east to 29.727557,-102.684802) to deter unlawful entries. DHS cites that between fiscal years 2021 and 2025 Border Patrol apprehended over 89,000 unlawful entrants in the Big Bend Sector and seized over 87,574 pounds of marijuana, over 867 pounds of cocaine, over 1,156 pounds of methamphetamine, over 12 pounds of heroin, and over 94 pounds of fentanyl.
