  • Families: Families with infants can get more flexible formula access during shortages. Programs may allow brand substitutions, waive some medical-documentation rules for noncontract formula, and lift monthly formula limits when needed.
  • State agencies and vendors: State agencies can get temporary waivers of administrative rules to keep benefits flowing. Waivers may run up to 45 days and can be renewed with 15 days notice. The Secretary must notify affected States and publish waiver determinations.
  • Manufacturers and federal coordination: Infant formula cost containment contracts must include remedies for recalls and require manufacturers to follow those contract terms during a recall. The Agriculture Department and the Department of Health and Human Services must sign a memorandum of understanding within 30 days to share information and coordinate responses to supply problems and recalls.

Stronger WIC formula recall protections

New and renewed WIC infant formula contracts must include recall plans. Contracted formula makers must carry out those steps to protect WIC families during a recall. USDA and Health and Human Services sign an agreement within 30 days of enactment to share recall and shortage information. This coordination helps keep access to formula when problems arise.

WIC rules eased during shortages and disasters

During formula or food shortages, or declared emergencies, USDA can ease WIC rules. Vendors can substitute comparable items, not just the same brand and size. The Secretary can waive some medical paperwork for noncontract formula (not for Food Package III) and waive the usual monthly formula limit. Changes must not lower nutrition. Shortage waivers run up to 45 days, can be renewed with 15 days’ notice, and end no later than 60 days after the shortage ends. Emergency waivers last through the emergency and up to 60 days after. USDA notifies states and posts decisions, and states alert contracted formula makers.
