Creates a federal civil remedy for people whose intimate images are captured without their consent. The bill would let victims sue someone who filmed, photographed, recorded, or broadcast an intimate visual depiction taken with knowledge of the lack of consent or with reckless disregard for consent.

Right to sue over secret intimate images
You would be able to sue in federal court if someone captured an intimate image of you without consent when you had a reasonable expectation of privacy. You could recover your actual damages or $150,000 per image, plus attorney’s fees and court costs. A judge could order the person to stop showing or sharing the image and let you file under a pseudonym. A parent, guardian, or estate could sue for a minor, an incapacitated person, or someone who died; the defendant could not serve in that role. Cases could go to federal court when the conduct ties to interstate or foreign commerce, like use of phones or computers, mail or wire, travel, payments, or equipment that crossed state lines; lawful police surveillance with a warrant would be excluded. The bill would define consent, capture, and what counts as an intimate image and a private area to set clear boundaries.
