Back pay with 6% interest for Delphi pensions

If enacted, PBGC would recalculate past payments to the new full‑vested amount and raise checks going forward as soon as practicable. If you were underpaid, PBGC would send a lump‑sum within 180 days after enactment. The lump‑sum would cover the shortfall plus 6% yearly interest on each past‑due month. You could ask PBGC to review any recalculation or lump‑sum decision through its normal appeal process.

Full pension guarantee for Delphi retirees

If enacted, some Delphi and PHI plan retirees and beneficiaries would get a higher guaranteed pension. The PBGC guarantee would match your full vested plan benefit, without the usual phase‑in and maximum caps. You must be in pay status or eligible at enactment, and not covered by certain 1999 GM top‑up deals. This would apply only to the listed Delphi and PHI plans and only to people who meet these rules.

Three‑year tax spread for lump‑sum back pay

If enacted, taxes on your lump‑sum back pay would be spread evenly over three tax years, unless you choose out. If you die before the three years end, the rest would be taxed in the year of death. A surviving spouse who gets a survivor benefit could elect to report the remaining amount instead.

New fund to pay Delphi benefits

If enacted, Treasury would set up a "Delphi Full Vested Plan Benefit Trust Fund." The government would provide whatever money is needed to make the extra payments and cover PBGC costs. The fund’s money would be available to send checks and run the program.
