Open vehicle data and repair rights

If enacted, the bill would require car makers to give vehicle owners and their chosen repair shops the same access to vehicle data, repair information, and tools that dealers get. Access must be available through OBD ports and, when available, wireless telematics. Data could only be used for diagnostics, repair, maintenance, or calibration unless the owner consents. Owners could name and revoke designees without limits. If you ask, stored vehicle data would have to be deleted within 72 hours, except for maintenance, accounting, or safety records. Makers could not force a specific parts brand and must show a clear notice when they recommend one.

FTC enforcement and oversight

If enacted, the bill would let anyone file a complaint with the Federal Trade Commission about violations of this law. The FTC would treat violations as unfair practices, investigate complaints, and must issue a final order within five months. The FTC would also send a public report to Congress every two years about investigations and recommendations. The Commission would create an advisory committee within 90 days to study repair competition and meet at least three times a year.

Federal override of state repair laws

If enacted, the bill would stop states from keeping or enforcing any law that conflicts with this federal law or the regulations under it. That would create one federal standard but could remove stricter state protections.

Dealer notice of owner repair rights

If enacted, NHTSA would have 180 days to make rules requiring manufacturers and dealers to tell buyers at purchase about the owner's rights under this bill. The rule would be written in consultation with the FTC.
