This bill would speed federal approvals for easements, rights-of-way, and leases for communications facility installations by creating a 'deemed granted' rule. It would replace the old “duly filed” standard with a clearer “complete” test and set timelines and receipt rules to trigger automatic grants when agencies miss deadlines.

  • Applicants for communications facility permits would get a clear completeness test. The test requires taking the first procedural step under the agency’s rules and not receiving a written notice within 30 days that lists missing information.
  • If an executive agency fails to grant or deny a complete application by the deadline, that application would be deemed granted on the day after the deadline.
  • The new rules apply to applications under section 6409(b) that are received by an executive agency on or after the date of enactment, and are aimed at reducing administrative delay.
