Foreign owners barred from farm programs

If enacted, any farm owner or operator who is a "foreign person" would not be allowed to take part in Farm Service Agency programs. Applicants would have to certify that they are not foreign persons. A foreign person who gets benefits anyway, or lies, could owe a civil penalty up to 125% of the benefits they received. Buyers, sellers, real estate agents, brokers, and title companies would need to do due diligence and certify compliance in farm land deals. USDA would monitor using AFIDA and FSA-153 data and report to Congress each year on violations, savings, actions, and penalties.

Stronger penalties for foreign land disclosures

If enacted, people who must file foreign agricultural land reports would face civil penalties from 5% to 25% for not filing, or for false or misleading filings. USDA would publish the names of people who paid these penalties. Penalty money would fund enforcement. USDA would also run a nationwide outreach program to help landlords, owners, tenants, appraisers, and auction companies understand the rules.

Funding to build agriculture tracking systems

If enacted, the bill would provide $35,000,000 in 2026 to build secure workspaces and databases, available until spent. It would also provide $9,000,000 each year from 2026 through 2030 for other activities under the Act. The Department of Agriculture and its contractors would use the funds to implement these systems.
