Tyler’s Law

Sponsored By: Representative Rep. Lieu, Ted [D-CA-36]

Introduced

Summary

Directs HHS to study and then issue guidance on fentanyl testing in hospital emergency departments. It would require a 1-year study and then guidance within 6 months to inform ED practice and policy.

Show full summary
  • Patients and families: The study would examine how fentanyl testing affects patient experience, confidentiality, and the patient-physician relationship. Findings could influence whether testing becomes a routine part of overdose care.
  • Clinicians and hospitals: HHS would gather data on how often EDs test for fentanyl, the costs of testing, and the benefits and risks. The guidance would also address how clinicians can know which substances are included in routine drug tests.
  • Federal policy and public health: Based on the evidence, HHS would issue federal guidance on whether routine fentanyl testing is recommended and how testing may affect future overdose risk and health outcomes.

Guidance on emergency room fentanyl testing

If enacted, HHS would study fentanyl testing in emergency rooms for overdose patients. The study would review how often testing happens, costs, patient risks and benefits, and effects on privacy and the patient–doctor relationship. HHS would have 1 year after enactment to finish the study. Within 6 months after that, HHS would issue guidance on routine testing and how to tell clinicians which drugs a test covers. The guidance would also address how testing may affect future overdose risk and health outcomes, and it would not mandate testing or add funding.
